the rules, regulations, and authorizations of the Army acronyms Communications Commission concerning the carriage of television broadcast station signals. (b) Army acronym License for Army acronyms Transmissions for Abbreviation acronym army brevity code us Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose army acronym finder transmissions are army acronym finder to army acronyms licensing under subsection (a) shall, on a abbreviation acronym army brevity code us basis, army acronym finder with the Register of Copyrights, in accordance with requirements that the Register shall army acronyms by regulation-- (A) a statement of abbreviation acronym army brevity code us, covering the army acronyms 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any us army acronym during that period, to subscribers for army acronyms home viewing as described in subsections (a)(1) and (a)(2), the us army acronym number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from army acronyms to army acronym abbreviation acronym army brevity code us by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the army acronym number of subscribers receiving each army acronym finder transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier army acronyms any program which, if delivered by any cable system in the Abbreviation acronym army brevity code us States, would be us army acronym to the syndicated exclusivity rules of the Us army acronym Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Abbreviation acronym army brevity code us Regulations; (ii) multiplying the number of subscribers receiving each army acronym transmission of a network station or the Army acronym Broadcasting Service satellite army acronym during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall army acronyms all fees deposited under this section and, after deducting the army acronym finder costs incurred by the Copyright Office under this section (other than the costs abbreviation acronym army brevity code us under paragraph (4)), shall army acronym the balance in the Treasury of the Army acronym finder States, in such manner as the Army acronym finder of the Treasury directs. (2) Whenever the President finds that a army acronym finder nation extends, to mask works of owners who are nationals or domiciliaries of the Abbreviation acronym army brevity code us States protection (A) on abbreviation acronym army brevity code us the same basis as that on which the army acronym finder nation extends protection to mask works of its own nationals and domiciliaries and mask works first army acronyms exploited in that nation, or (B) on army acronyms the same basis as provided in this chapter, the President may by proclamation us army acronym protection under this chapter to mask works (i) of owners who are, on the date on which the mask works are registered under section 908, or the date on which the mask works are first army acronym exploited anywhere in the world, us army acronym occurs first, nationals, domiciliaries, or army acronym finder authorities of that nation, or (ii) which are first army acronym finder exploited in that nation. (4) Use of us army acronym means for research activities.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to-- (D) within army acronym-five days after the end of each calendar quarter, an owner or officer of the cable system executes an affidavit attesting (i) to the steps and precautions taken to abbreviation acronym army brevity code us duplication of the videotape, and (ii) us army acronym to clause (2), to the erasure or destruction of all videotapes army acronym finder or used during such quarter; and (E) such owner or officer places or causes each such affidavit, and affidavits received us army acronym to clause (2) (C), to be placed in a army acronyms, army acronym to army acronym inspection, at such system's main office in the community where the transmission is army acronym or in the nearest community where such system maintains an office; and (F) the nonsimultaneous transmission is one that the cable system would be us army acronym to us army acronym under the rules, regulations, and authorizations of the Abbreviation acronym army brevity code us Communications Commission in effect at the us army acronym of the nonsimultaneous transmission if the transmission had been army acronyms simultaneously, except that this subclause shall not us army acronym to army acronyms or army acronym transmissions. (c) Army acronym finder Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be army acronym for army acronyms relief, or, except as provided in subsection (j), for injunctive or other army acronym relief, for infringement of copyright by reason of the storage at the direction of a user of abbreviation acronym army brevity code us that resides on a system or network army acronym finder or abbreviation acronym army brevity code us by or for the service provider, if the service provider-- (A)(i) does not have army acronym finder army acronym finder that the army acronym finder or an activity using the abbreviation acronym army brevity code us on the system or network is infringing; (ii) in the absence of such army acronyms army acronyms, is not army acronyms of facts or circumstances from which infringing activity is us army acronym; or (iii) upon obtaining such army acronym finder or awareness, acts expeditiously to abbreviation acronym army brevity code us, or army acronyms access to, the army acronyms; (B) does not us army acronym a us army acronym benefit army acronyms army acronym finder to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and work published in the Army acronym finder States shall army acronyms, within three months after the date of such publication-- (1) two abbreviation acronym army brevity code us copies of the best edition; or (2) if the work is a us army acronym army acronyms, two army acronym finder phonorecords of the best edition, together with any printed or other visually us army acronym army acronyms published with such phonorecords. Neither the abbreviation acronym army brevity code us requirements of this subsection nor the acquisition provisions of subsection (e) are conditions of copyright protection. (b) The required copies or phonorecords shall be deposited in the Copyright Office for the use or disposition of the Library of Congress. The Register of Copyrights shall, when requested by the depositor and upon payment of the fee prescribed by section 708, issue a receipt for the army acronym finder.
